The Court held that Texas Education Code §21.307(a)(2) does not require the Commissioner of Education’s consent for an appeal of his decision to be filed in a Travis County district court. Because the Commissioner is not one of the “parties” referenced in the statute, the venue provision applies only to the teacher and the school district. Accordingly, the Court reversed the Court of Appeals and remanded for further proceedings.
