Summary
The Texas Supreme Court held that the trial court did not abuse its discretion in denying the motion to disqualify the husband’s attorney under Rule 3.08, and therefore the Court of Appeals erred in granting mandamus to require disqualification. Accordingly, the Court conditionally granted mandamus and ordered the appellate court to vacate its disqualification order.
