Texas Supreme Court

In Re Adel Sheshtawy, Relator

December 31, 200448 Tex. Sup. Ct. J. 287

Summary

The Texas Supreme Court held that a trial court retains jurisdiction to enforce a final spousal maintenance judgment by contempt while an appeal is pending and the judgment is not superseded, and therefore vacated the commitment order that conditioned incarceration on payment of the reversed maintenance award. The Court also affirmed that the trial court may still impose criminal contempt for violations of its unsuperseded order.
