The Texas Supreme Court held that the Texas Water Commission (now the Texas Natural Resource Conservation Commission) has authority under Texas Water Code §12.013(a) to set wholesale water rates upon petition by a water supplier, and that this authority is not limited to cases where the supplier appropriates state water. Accordingly, the Court reversed the Court of Appeals' judgment that had held otherwise and remanded for further proceedings.
