Summary

The Texas Supreme Court held that a trial court may grant Rule 13 sanctions after a nonsuit while it retains plenary jurisdiction, and therefore reinstated the sanctions order. It also affirmed the appellate court’s reversal of the trial court’s summary judgment. The Court reversed the appellate judgment on the sanctions issue and remanded for further consideration of the Schexniders’ additional challenges to the sanctions order.
