The Texas Supreme Court held that under the Texas Whistleblower Act an employee need not prove the report was the sole reason for retaliation; it must be a necessary factor without which the adverse action would not have occurred. The Court also found that the trial court erred by failing to give the jury a proper causation instruction and therefore reversed the appellate judgment and remanded for a new trial.
