Texas Supreme Court
Renee McCracken Williams, Petitioners v. Steves Industries, Inc., D/b/a Ingram Equipment Company, Respondent
November 13, 198529 Tex. Sup. Ct. J. 53
Summary
The Texas Supreme Court affirmed the Court of Appeals, holding that there was no evidence of gross negligence by Steves Industries in entrusting its truck to an unlicensed driver, thus no punitive damages were warranted. The Court also held that Mrs. Williams' negligence in allowing her car to run out of gasoline was a proximate cause of the collision. Justice Ray dissented, arguing that the evidence supported a finding of gross negligence. The dissent does not affect the Court's holdings.
