The Texas Supreme Court affirmed the Court of Civil Appeals in part, holding that Clear Lake Apartments, Inc. is not bound by the exclusive service provision in the contract between Clear Lake Utilities Co. and North Clear Lake Development Corp.; that the trial court had jurisdiction to decide the dispute between Utilities and the Water Authority without joinder of all landowners; that the 1966 contract between Utilities and the Authority was valid and binding until terminated by the Authority's notice of May 2, 1975, and that Utilities is not entitled to damages for alleged conspiracy or tortious interference.
