Summary
The Texas Supreme Court held that the divorce decree of December 28, 1973 was final and that Article 2168a, the legislative continuance act, does not apply to post‑judgment motions to stay or enforce that final judgment. The Court, however, found that the contempt proceeding filed after the legislator‑attorney’s employment is a separate suit within the meaning of Article 2168a and therefore entitled to a mandatory continuance. Accordingly, the petition for mandamus was granted only as to the contempt hearing and denied with respect to the other motions.
