The Texas Supreme Court held that neither the 1944 nor the 1945 contracts expressly named Harris County, so venue could not be maintained there under the amended Subdivision 5 of Article 1995; consequently the Court granted the petition for mandamus, ordered the case transferred to Bexar County, and affirmed its jurisdiction to issue mandamus when a conflict in opinions exists. Justice Smedlby dissented, arguing the Court lacked jurisdiction to decide the venue question.
