Summary

The Texas Supreme Court held that a claim filed with the Industrial Accident Board need not state the amount of compensation sought for the purpose of establishing jurisdiction of the trial court that may be called upon to set aside the board’s award. Jurisdiction is determined by the amount in controversy as alleged in the petition, regardless of whether the board claim states an amount. Accordingly, the Court reversed the Court of Civil Appeals and the district court and remanded the case for further proceedings.
