Court of Criminal Appeals of Texas

Danny Ray Harris, Appellant v. the State of Texas, Appellee

February 9, 19831983 Tex. Crim. App. LEXIS 909

Summary

The Court held that Texas law does not prohibit conducting a sentencing proceeding on a Sunday and therefore the trial court did not err on that ground. However, the Court found that the trial court erred by failing to submit to the jury the question of whether the juvenile witness, Valarie Rencher, was an accomplice witness, and reversed the capital murder conviction and remanded for a new sentencing proceeding.
