Summary

The Court held that a PSERS member is not barred from purchasing service credit for prior out-of-state service merely because she previously received a lump-sum retirement benefit for that service. The statutory bar applies only when the member is currently receiving, entitled to receive, or eligible to receive now or in the future, retirement benefits from the other system. Because Esch had terminated her membership in the Arizona system and retained no current or future entitlement, the Court reversed the Commonwealth Court.
