Summary

The court held that the State presented substantial evidence from which a jury could find that defendant constructively possessed the firearm found in an unlocked dresser in a shared bedroom. In reaching that conclusion, the court required the evidence to be viewed in the light most favorable to the State and considered the totality of circumstances, including defendant's occupation of the home and bedroom, proximity to the firearm, opportunity to place it there, and suspicious behavior. The court reversed the Court of Appeals and remanded for consideration of remaining appellate issues.
