Summary

The Court reversed the Court of Appeals and reinstated Moore’s first-degree kidnapping conviction. It held that, although restraints necessary to suffocate the victim were inherent in the murder, additional cables and zip ties that bound her to the bed and contorted her body constituted substantial evidence of an independent restraint supporting kidnapping.
