Summary

The New York Court of Appeals affirmed the Appellate Division, holding that the People have no duty to charge the Grand Jury with a mental disease or defect defense nor to present the defendant's psychiatric history to the Grand Jury. The Court also held that the defendant's incompetence at the time of the Grand Jury presentation did not violate CPL 190.50, and therefore the indictment stands.
