Summary
The New York Court of Appeals held that a district attorney who simultaneously served as corporate counsel and stockholder of the corporation whose conduct formed the basis of the indictment was conflicted and therefore the indictment should have been dismissed. The Court reversed the Appellate Division's order upholding the conviction and ordered dismissal without prejudice, allowing the State to re‑present the case to a Grand Jury.
