Summary
The New York Court of Appeals held that a waiver of an employer's right to discharge an employee, when induced by the employee's fraudulent misrepresentation, is ineffective and may be rescinded. Accordingly, the Court reversed the Appellate Division and reinstated the trial court's judgment that the pension benefits were void. The Court also affirmed summary judgment on the employer's counterclaim for the $16,000 bribe and affirmed the judgment for the remaining $15,750 claim.
