New York Court of Appeals
Abby S. Martin, Respondent v. Edward Funk
November 12, 187875 N.Y. 134
Summary
The Court held that the deposits made by the intestate, accompanied by a declaration that the accounts were held in trust for the plaintiffs, constituted a valid trust and transferred title to the beneficiaries. Retention of the pass‑books by the depositor did not defeat the completeness of the trust, and notice to the beneficiaries was not required. Accordingly the judgment in favor of the plaintiffs was affirmed.
