The Court held that the equitable distribution statute reaches only the portion of Thieme’s deferred compensation earned during the parties’ marriage, not the portion earned during their prior cohabitation. It nevertheless held that the circumstances supported an unjust-enrichment claim and justified imposing a constructive trust over part of the compensation earned during cohabitation. The judgment was affirmed in part, reversed in part, and remanded for allocation of the compensation.
