Supreme Court of Missouri
Kate Goerlitz, Appellant v. City of Maryville, Missouri, a Municipal Corporation, Respondent
January 11, 20112011 Mo. LEXIS 1
Summary
The Court affirmed summary judgment for the City, holding that the governing firearm-range statute barred Goerlitz's requested injunctive relief based on nuisance or trespass. Goerlitz also failed to provide admissible, personally supported evidence that bullets physically injured her or her property, and her negligence claims could not independently support an injunction. Judge Laura Denvir Stith, concurring in result, agreed that the pleaded nuisance and trespass claims were barred but would not read the statute to foreclose injunctions based on other torts.
