Supreme Court of Louisiana
Ramey v. DeCaire
March 19, 2004869 So. 2d 114
Summary
The court held that plaintiffs' amended petition did not plead sufficient facts to state a negligence cause of action arising from Dr. Ramey's suicide because it did not establish a relationship giving defendants a duty to prevent the suicide or explain how their negligence was a substantial factor in causing it. The court nevertheless reversed and remanded with instructions to allow plaintiffs another opportunity to amend under the applicable procedural rule. If plaintiffs failed to amend within thirty days after the judgment became final, the district court was instructed to dismiss the suit.
