Kentucky Supreme Court
Caesars Riverboat Casino, LLC and Harrah’s Entertainment, Inc., Appellants v. Carla Beach, Appellee
March 24, 20112011 Ky. LEXIS 38
Summary
The Court held that Kentucky's long-arm statute must be applied independently before determining whether jurisdiction satisfies federal due process. Although the defendants conducted substantial business in Kentucky, the plaintiff's Indiana slip-and-fall claim did not arise from those Kentucky activities because there was no reasonable and direct nexus between the marketing conduct and the alleged negligence. The Court therefore reversed the Court of Appeals and reinstated the circuit court's dismissal for lack of personal jurisdiction.
