Summary

The Indiana Supreme Court reversed the termination of Father’s parental rights because the evidence did not clearly and convincingly establish either that the reasons for placing the child outside Father’s home would not be remedied or that continuing the relationship threatened the child’s well-being. The court held that the trial court failed to identify the conditions leading to the child’s placement in foster care instead of with Father, and that the evidence concerning bonding and threat was insufficient.
