Summary

The Illinois Supreme Court reaffirmed the governing Illinois standard for successive postconviction claims of actual innocence and rejected the State's proposed heightened federal-style burden. Applying that standard, the court held that the newly presented testimony, considered with the trial evidence, was sufficiently conclusive to undermine confidence in the conviction and probably produce a different result on retrial. The court therefore reversed the circuit and appellate court judgments and remanded for a new trial.
