Idaho Supreme Court
Viktoria v. Devai v. John M. Burk
July 15, 2026
Summary
The Court affirmed the custody-modification judgment, holding that substantial and competent evidence supported the findings that no statutory domestic violence or child abuse occurred and that the increased parenting-time schedule served the child’s best interests. It also upheld the limited delegation allowing the respondent to select an initial school if the parents and parenting coordinator could not resolve the issue, and upheld reliance on the neutral parenting-time evaluation. The appellant’s judicial-bias allegations were waived because they were not properly presented or supported on appeal.
