Summary

The Idaho Supreme Court reversed the district court’s summary judgment in part, holding that the Thaetes’ failure to serve their notice of appeal was not jurisdictional, that Dr. McIlraith’s expert testimony was admissible, and that summary judgment was improper as to Dr. Fry but proper as to St. Luke’s. The case was remanded for further proceedings and the Thaetes were awarded costs.
