In Re: Amendments to Florida Probate Rules - 2026 Legislation

Summary

Acting on The Florida Bar Probate Rules Committee's fast-track report, the Supreme Court of Florida amended Florida Probate Rules 5.025 (Adversary Proceedings), 5.425 (Disposition Without Administration in Small Estates), and 5.530 (Summary Administration) to conform the rules to chapter 2026-57, Laws of Florida, effective July 1, 2026. The amendments add proceedings to enforce a personal representative's authority under section 733.612 to the adversary-proceeding list, raise the disposition-without-administration property threshold from $10,000 to $20,000, and raise the summary-administration estate value cap from $75,000 to $150,000. The amendments are effective immediately, and because they were adopted without prior publication for comment, interested persons have 75 days to file comments with the Court. No separate opinions were filed.
