Supreme Court of Florida

Bryant v. State

March 19, 1992601 So. 2d 529

Summary

The Supreme Court of Florida affirmed Robert Bryant's convictions and all sentences except the death penalty, holding that the trial court erred by refusing to excuse jurors who would automatically impose death and by failing to give the jury a mitigating instruction on extreme mental or emotional disturbance. Because of these errors, the Court remanded for a new penalty phase before a new jury.
