Summary
The court held that the trial court abused its discretion by dismissing a deliberating juror on the sixth day of deliberations because the record left a reasonable possibility that the juror was removed for holding views favoring acquittal. A juror who has participated in deliberations may not be removed merely because the juror later disengages or refuses to change a position, absent a firmly established, merits-unrelated reason. The court reversed the convictions and remanded for a new trial.
