Summary
The Court held that children born in the United States to parents who are unlawfully or temporarily present are subject to the jurisdiction of the United States and are citizens at birth under the Fourteenth Amendment's Citizenship Clause. Relying on the historical understanding of birthright citizenship, the text and context of the Citizenship Clause, and precedent confirming jus soli, the Court rejected a domicile-based limitation. The Court therefore affirmed the District Court's judgment and preliminary injunction against enforcement of the Executive Order.
