Summary
The Court held that the Helms‑Burton Act expressly abrogates the foreign sovereign immunity of Cuban agencies and instrumentalities, so plaintiffs suing under the Act need not satisfy any FSIA exception. Accordingly, the judgment of the D.C. Circuit was reversed and the case remanded for further proceedings consistent with this holding.
