Summary

The court affirmed Hodges’s convictions and life sentence. It held that officers had probable cause to arrest him and search him incident to arrest, and that excluding proposed impeachment evidence did not violate Rule 403 or the Confrontation Clause. Although the district court plainly failed to personally invite Hodges to allocute, the error did not warrant relief because Hodges did not assert that he would have allocuted; the court also upheld the sentencing enhancements, upward departure, and limited weight given to mitigation evidence.
