Supreme Court of Oklahoma
Community Resourcing, Inc. v. Berkshire Hathaway Specialty Insurance
June 30, 20262026 OK 53
Summary
The Court held that the insured's tortious-interference and civil-conspiracy claims against the engineering company were legally unavailable because the company acted as the insurer's representative while inspecting the insured's property. The contractual representative relationship also supplied justification for the company's conduct and defeated the underlying tort theory supporting the conspiracy claim. The Court therefore reversed the denial of the motion to dismiss and remanded for further proceedings.
