Nebraska Supreme Court
State of Nebraska on Behalf of Kaaden S., a Minor Child, Appellee v. Jeffery T., Appellant, and Mandy S., Appellee.
August 30, 2019932 N.W.2d 692
Summary
The court held that Nebraska law does not favor or disfavor joint physical custody and that custody and parenting-time decisions must be based on the child's best interests rather than a categorical presumption. Because the alternating-week schedule was supported by the evidence and did not constitute an abuse of discretion, the court reinstated the custody, parenting-time, and child-support determinations, while affirming the reversal of the order requiring the father to pay the first $480 of nonreimbursed health care expenses. No separate opinions were filed.
