Montana Supreme Court
Marriage of DeCock
July 7, 20262026 MT 145
Summary
The Court affirmed the deemed denial of Taralyn DeCock’s Rule 60(b)(6) motion seeking relief from the dissolution decree. It held that the motion improperly attempted to relitigate the previously rejected challenge to the marital property agreement and that Taralyn independently failed to show that she was blameless because she later affirmed the agreement and requested its incorporation into the decree. The Court also determined that challenges to the decree itself were untimely because the notice of appeal was filed more than 30 days after entry of the decree.
