Supreme Court of Missouri

Michael Keveney, Respondent/cross-Appellant v. Missouri Military Academy, Appellant/cross-Respondent

February 9, 20102010 Mo. LEXIS 10

Summary

The court held that an employee working under an employment contract may pursue a wrongful-discharge claim based on a clear public-policy mandate, just as an at-will employee may. Keveney adequately pleaded that he was discharged for insisting that suspected child abuse be reported as required by law, and the court therefore reversed dismissal of that claim. The court also affirmed the breach-of-contract judgment because sufficient evidence supported the jury's finding that Keveney performed his contractual duties.
