Summary

The court affirmed Milano’s convictions for capital murder and kidnapping, concluding that the challenged jury instructions and evidentiary rulings did not constitute reversible error. Although the aiding-and-abetting instructions were erroneous because they permitted conviction based on committing any act constituting an element, the error was harmless when the instructions were read together. The court also prospectively adopted a pattern instruction on aiding and abetting.
