Summary

The Michigan Supreme Court held that police violated defendant's Miranda-based Fifth Amendment right to counsel by giving confusing information implying that appointed counsel was unavailable because defendant lacked money and by continuing the interrogation after defendant invoked counsel. Defendant's later statements were inadmissible because he did not reinitiate questioning and police engaged in the functional equivalent of interrogation. The court reversed the Court of Appeals and remanded for further proceedings.
