Acting on the Florida Bar's Probate Rules Committee proposal in this original rulemaking proceeding, the Supreme Court of Florida amended the Florida Probate Rules as set out in the appendix to the opinion, effective October 1, 2026, at 12:01 a.m. The amendments conform cross-references throughout the probate and guardianship rules to the recently retitled Rules of General Practice and Judicial Administration 2.516 ('Service') and 2.525 ('Filing'), add 'and protection of' to references reflecting the correct title of rule 2.420, make grammatical revisions in compliance with the Guidelines for Rules Submissions, and revise committee notes, with rules 5.041, 5.120, and 5.355 restructured. The proposal was published for comment and no comments were received. No separate opinions were filed.
