Summary
Acting on the Florida Bar's Probate Rules Committee report, which was published for comment and drew a single comment and Committee response, the Supreme Court of Florida amended Florida Probate Rules 5.025, 5.122, 5.200, 5.320, and 5.470 as proposed, with minor revisions. The significant changes require letters of curatorship to specify the powers granted to the curator over all or part of the decedent's property, and add statutory references to sections 825.102 and 825.103, Florida Statutes, in the petition for administration and the oath of personal representative. Grammatical and consistency edits were made throughout in compliance with the Court's Guidelines for Rules Submissions. The amendments take effect October 1, 2026, at 12:01 a.m., and the filing of a motion for rehearing will not alter that date.
