The court held that the evidence, viewed favorably to Hall and Hughes, could allow a reasonable jury to find that Coal Bed Services discriminated against them because of race and retaliated against them for complaining about racial discrimination. The court concluded that the differing treatment of a White coworker, inconsistent explanations for the drug testing, replacement hiring, and other workplace evidence created genuine disputes of material fact under both Title VII and 42 U.S.C. § 1981. The court reversed the grant of summary judgment and remanded for further proceedings.
