The court dismissed Music Choice's petition for review because the Copyright Royalty Board's regulatory-interpretation ruling was not a reviewable determination under Section 803(c)(4), and Music Choice was not a qualifying participant bound by that ruling. The court held that Section 803(c)(4) permits only amendments correcting minor technical or clerical errors, not post hoc interpretations of substantive regulatory ambiguities. Music Choice and SoundExchange may return to the pending district-court litigation, where the district court will decide what weight, if any, to give the Board's nonbinding interpretation.
